The article presents the antecedents and history of the 'Juzgado General de Bienes de Difuntos', an Spanish Colonial Law institution, which had been aborded through the analysis orf the sources, but had not counted with studies that give account of the historical unfold of such institution and the profuse normativity used to regulate it. To fill such a void, the author analyzes tha nature of the 'Juzgado', the relation with other Indian institutions, its juridical regulation and the tribunal casusistic.
